The Volcom Snowboard Sweepstakes — Official Rules

THE SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, CANADA (EXCLUDING QUEBEC), AND UNITED KINGDOM WHO ARE AT LEAST THIRTEEN (13) YEARS OF AGE AT THE TIME OF ENTRY.

1. NO PURCHASE NECESSARY: Purchase, payment, or clicks on search or sponsored results of any kind will NOT improve your chances of winning, nor will they result in additional Sweepstakes entries.

2. PERIOD: The Volcom Snowboard Sweepstakes Period ("Sweepstakes Period") begins at 12:00:01 a.m. Pacific Standard Time ("PST") on 4-01-2010 and ends at 11:59:59 p.m. (PST) on 9-6-2010.

3. ELIGIBILITY: The Volcom Snowboard Sweepstakes (the "Sweepstakes") is open only to the legal residents of the 50 United States and the District of Columbia, Canada (Excluding Quebec), and United Kingdom who are at least thirteen (13) years of age and have an existing Internet connection as of the Sweepstakes Period start time. The Sweepstakes is limited to entries originating from within the 50 United States, and the District of Columbia (Void in Maine), Canada (Excluding Quebec), and United Kingdom who are at least thirteen (13) years of age at time of entry, and is subject to all applicable federal, state, provincial, territorial and local laws and regulations. Void where prohibited. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor and judge's decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Employees and directors of Volcom and Santa Barbara Group, LLC ("Sponsor" or "Santa Barbara Group") and their affiliates, advertising agencies, suppliers and/or promotional partners and members of their immediate families together with whom such employees are domiciled are not eligible to enter or win.

4. ENTRANT: An entrant ("Entrant") must be a natural person who is the authorized account holder of a registered email address used to conduct the search and create a free user account. In any dispute as to any entry, the authorized account holder of the registered email address used to conduct the search and create a free user account will be deemed to be the Entrant. Potential winners may be required to show verifiable proof of being the authorized account holders. A maximum of one (1) account per household is allowed.

An Entrant may not enter with multiple identities. Any Entrant who attempts to circumvent these Sweepstakes Rules ("Rules") by entering with multiple identities or using any device or method to obtain more than the maximum number of entries may be disqualified.

BY PARTICIPATING IN THE SWEEPSTAKES, ENTRANTS EXPRESSLY CONSENT TO THESE OFFICIAL RULES, THE TERMS AND CONDITIONS OF THE SANTA BARBARA GROUP WEBSITES, AND THE SANTA BARBARA GROUP PRIVACY POLICY LOCATED AT privacy policy, ALL OF WHICH ARE HEREBY INCORPORATED BY REFERENCE (collectively, the "Official Rules"). If you do not agree to any of these terms, please do not participate in the Sweepstakes.

5. HOW TO ENTER: There are two (2) ways to enter the Sweepstakes.

a. Visit http://search.volcom.com ("Participating Site") during the Sweepstakes period and follow the links and instructions to complete and submit the registration form and create a free user account by submitting your name, age, city, state, province, or country, and email address. You automatically will receive one (1) entry into the Sweepstakes. (Information collected from Entrants is subject to the Santa Barbara Group Privacy Policy located at privacy policy.)

b. Visit http://search.volcom.com ("Participating Site") during the Sweepstakes period, enter a search term using the Santa Barbara Group Search Services ("Search Services") and hit the search button to enter. You must enter a different search term for each entry. The device through which you access Sponsor's website to enter must accept cookies or any similar, successor, known, or hereinafter devised technology which Sponsor does or may use to track Sweepstakes entries. Sponsor will not disclose any cookie results to third parties except as required under statute, court order, warrant, subpoena, or any other legal process. Please note that the Santa Barbara Group privacy policy applies only to the Santa Barbara Sites, and not to the Web sites of other companies or organizations to which we provide links.

If you receive a Rewards points icon ("Prize Notification"), you must reply within five (5) minutes by clicking the SUBMIT + CLAIM REWARD button. You must then log in to your user account at the Participating Site on which you received the Prize Notification (or create a free user account if you do not already have one by submitting your name, age, city, state, province, or country, and email address), and record your Prize Notification as instructed within one (1) hour of receipt of the Prize Notification and Sponsor will validate your entry. Once you complete and submit the registration form, you will automatically receive one (1) entry into the Sweepstakes. Validation will require that the potential winner provide all requested information and meet all eligibility requirements. Potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Use of a false email account or an incorrect mail address will disqualify an entry.

6. PRIZE: ONE (1) GRAND PRIZE: Volcom Snowboard. Total Approximate Retail Value ("ARV"): $500 USD Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning the Sweepstakes prize depend on the number of eligible entries received during the Sweepstakes Period.

7. WINNER SELECTION: Winners will be selected in a random drawing from all eligible entries received on or about June 29, 2010. Odds of winning depend on number of eligible entries received. Winners will be notified by e-mail after the date of the random drawing. By entering the Sweepstakes, entrants accept and agree to these rules and the decision of the judges, which shall be final. If a potential winner cannot be contacted, or prize is returned as undeliverable, potential winner forfeits prize. Potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries from the applicable Sweepstakes Period. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. By submitting an entry, a winner agrees to allow use of his or her name, likeness and/or biographical information for promotional purposes (including posting on this Web site), except where prohibited. Prizes will be fulfilled within eight (8) to ten (10) weeks after the conclusion of the Sweepstakes. All Canadian winners will receive prizes the later of either two (2) to three (3) weeks after the receipt of their skills test or eight (8) to ten (10) weeks after the conclusion of the Sweepstakes.

8. VERIFICATION: All potential winning searches and all potential winners are subject to Sponsor verification. The Sponsor's decisions are final and binding. An Entrant is not deemed a winner of any prize, even if the winning notification should so indicate, unless and until the Entrant's eligibility and potential winning search has been verified and the Entrant has been notified that the acceptance and verification process is complete. To be deemed a winner an Entrant must follow and complete the prize acceptance and verification process as directed. Sponsor will not accept any external evidence of winning, such as screen shots, in lieu of the full completion of its acceptance and verification process.

9. SPECIAL RULES FOR CANADA AND UNITED KINGDOM RESIDENTS:
a. For residents of Canada: If you are a potential winner you will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered by either telephone or e-mail. If you answer the skill-testing question incorrectly, as determined by us in our sole discretion, you will be disqualified and, at our discretion, an alternate winner shall be chosen from among all remaining eligible entries.

b. For residents of the United Kingdom: Provisions of the Contracts (Rights of Third Parties) Act 1999 shall not apply to this agreement.

10. QUALIFICATION; GENERAL CONDITIONS: Sponsor may, at its sole discretion, disqualify any searches it believes were created by an automated system. Sponsor may, at its sole discretion, disqualify any searches it believes do not represent legitimate use of the Search Services. Such non-legitimate uses include, but are not limited to: searches for letters of the alphabet, random numbers, or other irrelevant search queries; searches for the same word or phrase; any other searches which do not appear to represent a legitimate use of the Search Services.

Sponsor is not responsible for, and may at its sole discretion disqualify, any incomplete, lost, late, misdirected, garbled, incompletely received, or otherwise illegible or invalid searches or prize claims, regardless of the cause of the failure. Sponsor is not responsible for any aspect of Entrant's hardware, software, browser, network, or Internet connection which is or may be incompatible with any aspect of the Search Services or Sweepstakes. Sponsor is not responsible for any Entrant or Sponsor mistake or malfunction, technical, human, or otherwise, or any Internet or phone connection failure, delay, or congestion which may prevent an Entrant from accruing a valid Qualifying Search or completing the prize acceptance and verification process, or which may prevent the Sponsor from administering the Sweepstakes or processing the entries. Sponsor reserves the right in its sole discretion to disqualify any Entrant or individual it finds to be tampering with or disrupting the entry process or operation of the Sweepstakes, and/or to be acting in violation of these Rules.

Sponsor reserves the right to modify, suspend and/or terminate this Sweepstakes or any part thereof in the event that it becomes infected by a computer virus or is otherwise technically impaired, or if the Sweepstakes cannot be conducted as planned by causes beyond the reasonable control of Sponsor, as determined by Sponsor in its sole discretion. Any search that occurs after the system has failed for any reason is deemed a defective search and is void in all respects.

Caution. Any attempt by an Entrant or other user to deliberately damage or undermine the legitimate operation of the Sweepstakes, or to detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information may be in violation of criminal and/or civil laws and will result in disqualification of such Entrant. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages, including attorney's fees, from any such Entrant or participant to the fullest extent of the law, up to and including criminal prosecution.

11. PUBLICITY; RELEASE: Acceptance of any prize constitutes consent and agreement to use winner's name (first name and last initial), hometown, and likeness for editorial, advertising and publicity purposes, whether on a website or any other communication medium, without further compensation, except where prohibited. By entering and/or accepting a prize, you agree to release and hold harmless Volcom and Santa Barbara Group, their subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, all respective parent companies, directors, officers, employees, and agents (collectively, the "Released Parties") from any and all liability arising out of your participation in the Sweepstakes with respect to the awarding, receipt, use and/or misuse of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. Winner's travel companion may be required to sign a release of the Released Parties from any and all liability arising out of such travel companion's use and/or mis-use of any prize, including without limitation, personal injury, death and property damage and claims based on publicity rights, defamation or invasion of privacy.

Each potential winner (or parent/legal guardian if winner is a minor in his/her state of residence) may be required to sign an affidavit of eligibility, a publicity release (where permitted by law), and a liability release which must be signed and returned within 14 days of the date on the prize notification or prize will be forfeited and an alternative winner will be chosen. Return of any prize notification as undeliverable will result in disqualification and selection of an alternate winner.

12. DISPUTES; GOVERNING LAW: Participation in the Sweepstakes constitutes your full and unconditional agreement to be bound by these Official Rules and any and all decisions of the Sponsor. Except where prohibited, the Entrant agrees that any and all disputes, claims and causes of actions arising out of or connected with the Sweepstakes or any prize shall be resolved on an individual basis without resort to any form of class action.

Except where prohibited, any and all disputes, claims and causes of actions shall be resolved exclusively by the United States District Court for the Central District of California, or the appropriate California State Court located in Los Angeles County, California. Any issues or questions of construction, interpretation, validity, or enforceability of these Rules, or the rights and obligations of the Entrant and/or Sponsor in connection with the Sweepstakes shall be governed by, construed and interpreted in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rule which would cause the application of the laws of any jurisdiction other than the State of California.

Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorney's fees. Entrant hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you.

13. SWEEPSTAKES RESULTS: For a list of The Volcom Snowboard Sweepstakes winner and/or a copy of these Rules, send a stamped, self-addressed envelope to: Santa Barbara Group, LLC, 2118 Wilshire Blvd. #1144, Santa Monica, CA 90403. Sweepstakes results requests will only be accepted after the Sweepstakes period end date (listed above) and no later than July 31, 2010.

14. PERSONAL INFORMATION. Information collected from Entrants is subject to the Santa Barbara Group Privacy Policy located at the following link: privacy policy.

15. LIMITATIONS OF LIABILITY: The Released Parties (as defined above in Section 11) are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
